fight speeding tickets.<br />
Step 1 Collect evidence: When you are fighting against speeding tickets, request the traffic court to show you<br />
the official documents,as calibration records for either the radar gun or speedometer used to catch your speed.</p>
<p>Submit a discovery request to the prosecutor in advance to consider the documents provided in advance for failures.<br />
But note that if you subpoena the documents,you run the risk of<br />
reminding the officer of the incident, which could lead to he / she being present in court.</p>
<p>Step 2 Beat the beam: when fighting speeding tickets, keep in mind that devices for measuring speed such as radar and laser<br />
(also known as LIDAR, or light detection and range) are subject to human error. In some cases, officials have not<br />
sufficient evidence to give good positioning LIDAR test, then the case has been dismissed.</p>
<p>Step 3 Check all technicalities: to fight speeding tickets, keep in mind that if some elements of a<br />
Ticket are missing, the case may be expelled. For example, if the officer's name and signature are illegible<br />
and if the number plate is unreadable, then the case should be dismissed.</p>
<p>Be Brief Step 4: When in the fight against speeding tickets, keep in mind that judges do not have a lot of time.<br />
Give a brief report. Furthermore, the use of visual evidence such as a picture of a road sign obscured by foliage<br />
can help your case.</p>
<p>Step 5 wins by default: When fighting speeding tickets, if the officer does not appear, and the court asks for a<br />
continued (postponed for another day), then your response should be, "I object." The case should be dismissed<br />
if the officer does not have a good reason to be absent from the court.</p>
<p>Tips &amp; Warnings<br />
Fines for speeding can increase your insurance, cause accidents and other hazards. The best way to avoid receiving<br />
a ticket is not to drive in excess of the speed limit.</p>

<p>Speeding is a common thing that we all do at one point or another in our lifetime. We've all been late to an important meeting or event, or need to rush quickly to get somewhere fast in a limited amount of time. Either way, we forget that we might be cruising over the speed limit, only to end up getting pulled over by the<span id="more-23"></span> police. Of course, this puts a damper on anyone's day. Getting pulled over was already stressful enough, but the financial burden for the speeding ticket you just were issued is another story in itself.<br />
But, what if you didn't have to pay that fine? What if there were legitimate ways you knew of that could get you out of paying that ticket? Believe it or not, many people have contested their speeding tickets legally and have gotten away with it, never to pay a fine again!<br />
So, how can you go about contesting your speeding ticket in the right manner? Here are a couple good tips to get you started.<br />
Show up to court<br />
If you pay your fine, you immediately admit your guilt, so why not show up in court to contest your ticket? Showing up won't get you off the hook, but if the officer who pulled you over doesn't show up for court that day, guess what? Your ticket is automatically dropped and dismissed. How easy is that?<br />
Be on point with your story and keep records<br />
It's your word against the officer's. Whose do you think that the court is going to lean more towards? If you got pulled over for a reason that wasn't legit, then you need to make sure you have your story and your facts straight. Lying to the court won't get you anywhere, and you'll still end up being slapped with a fine.</p>

<p>Speeding tickets are a safety measure taken for safe driving. Your fast speed may prove to be faster for another person on the road to final upliftment. This may even be allotted to you. Speeding tickets are for saving lives.</p>
<p>Are there any strategies for avoiding speeding tickets? How can one take care of this embarrassing situation? There are some ways<span id="more-22"></span> you can avoid being caught and issued the speeding ticket.</p>
<p>First and foremost thing to consider is to look at the hiding places. Where do police locate themselves to catch the offenders? These are usually behind trees, rocks or on the other side of the hill. You may not know that a patrol vehicle is exactly in front of a truck you are trying to overtake. Ramps are another favorite pace for patrol police to keep an eye. Be careful at the spots where you are unable to see the other side of the road. This is the most suspect place. You are trying to overtake a truck going at the legal speed. Naturally, you will have step the gas to overtake it. This may be a trap for you. You may be intercepted by a police patrol. Another tendency is to switch to the wrong lane to overtake a speeding vehicle. This is a sure shot formula for getting caught.</p>
<p>Although you can't do much about the car color, however a bright color car draws more attention than a run of the mill color. Try to have a normal color car which doesn't draw that extra special attention from the police.</p>
<p>There is another trick called rabbit chase. A rabbit is the car which has overtaken you beyond the legal speed. Follow that car keeping respectable distance with close attention on your rear view mirror. The radar equipment will first spot the rabbit car, and you are saved. However, if the patrol police car has spotted the rabbit car, they may have started chasing the car.</p>
<p>If you are wise enough, your observation in the rear view mirror will tell you to speed down a little. The patrol car will overtake you and catch the rabbit. If you are not wise enough, the probability id that the rabbit will go to jungle and you will be dealing with another piece of speeding ticket.Never follow a pattern on lane driving. Try to keep as much on the right side as possible. If you are snaking through the traffic, you are likely to be spotted easily, and you will be entitled for speeding and reckless driving.</p>

<p><strong>No1</strong>&nbsp; I wasn't actually speeding and i have notes to prove it!</p>
<p>You can't hope to challenge the officer's recollection of events. If there were other cars around at the same time he will say there&nbsp;you were the&nbsp;only one and he will be believed. (You don't think the court is going to take your word or the word of a biased witness against an officer of the law do you?)</p>
<p><strong>No2&nbsp;&nbsp; </strong>There is a mistake on my ticket!</p>
<p>It would have to be a fatal flaw not just an immaterial mistake for you to get out on this count. If the license plate # is wrong but the officer still identifies your car he wins.&nbsp;If he spells your name wrong you still lose. If he says you were in a black pickup and you were in a white van then you could win!</p>
<p><strong>No3&nbsp;</strong>&nbsp; Try to get your case postponed hoping the officer won't show up!</p>
<p>If&nbsp;the officer does show up what do you do then?? There is a book available that advocates you try to find out when the officer is on vacation and trying to schedule the trial for then. Seriously though this is extremly unlikely to work.</p>
<p><strong>No4&nbsp;</strong>&nbsp; Claim "Speeding out of Necessity" or some other excuse you think can't fail!</p>
<p>You had better have someone seriously ill on the backseat to make this one work!</p>
<p><strong>No5</strong>&nbsp;&nbsp; Plea Bargain to go to traffic school</p>
<p>These folks go through heaps of these cases and have heard all this before. Most pleas fall on deaf ears. If they are willing to negotiate they will ask you!</p>
<p><strong>No6</strong>&nbsp;&nbsp; Trip the officer up through clever questioning</p>
<p>If you are really really clever you may catch him out this way but remember he is trained and does this all the time, also the court is on his side so highly unlikely.</p>
<p>If you really want to beat your speeding ticket you will need to have sound preperation and researched proven legal Strategy.</p>

<p>Depending on how<span id="more-16"></span> fast you were going over the legal, posted speed limit, it might be wise to consult with a traffic ticket specialist. However, many people are ticketed when their speed is over the limit, but not dramatically. These people would do well to save the money associated with an expert and take the matter into their own hands.</p>
<p>It seems daunting to imagine going into court without a lawyer or someone familiar with the ins and outs of speeding tickets. All the average citizen needs to do is research traffic laws and come prepared with whatever materials they feel will help them fight the citation.</p>
<p>It's important to note that when you do have a court appearance often the officer who issued the ticket will be there to testify as well. If you admitted speeding to him or her, your defense becomes that much more difficult. Admitting guilt of speeding is accepting the guilt. If you've done that your best remedy will probably be to pay the fine. You could try and explain your speeding a couple of different ways. One is that you have to increase your speed because of someone else's careless driving. For instance, if someone is right behind you driving fast and you become concerned that they are going to hit you, you might increase your speed to avoid that. This defense is probably not going to work but if it what happened, than sharing it with the judge is important. Another could be road conditions. If there was something on the road, you might have sped up to pass it, or to avoid it. Again, this is difficult to prove and a judge might be skeptical.</p>
<p>If you weren't able to see the posted speed because the sign was either covered by some foliage or perhaps knocked over, there are important steps you need to take before you go to court. As soon as possible after you have been ticketed, you need to take pictures of the sign in the same condition you saw it in. It's crucial that this be done quickly. Having that type of evidence to show the judge, will allow him or her to see that although you were going over the posted limit, not having knowledge of that limit might have played a role in your infraction.</p>
<p>Taking the issue of your speeding ticket to court involves being prepared. Bring any notes or pictures that you have taken since that day. Be ready to take the witness stand and tell the truth in regard to what transpired when you received your speeding ticket. Also, be of the mind that although you've put time and effort into your own defense, you might still have to pay the fine as it was administered to you initially.</p>

Whether by trying to talk the officer out of a ticket there at the scene, or by going to court in hopes of getting your ticket dismissed.  Ticket dismissal is not as common as it could be if people knew how to properly go about getting out of a speeding ticket.  Use these following tips the next time you get<span id="more-15"></span> pulled over and maybe you will be able to get out of your speeding ticket.</p>
<ul>
<li>Be courteous and respectful to the officer.  Act like a fool and you may find yourself in jail.  If you disagree with the ticket, on the side of the road is no place to argue about it.  That is what the court system is for.</li>
<li>Ask to see the radar.  Make sure you do this politely!  </li>
<li>After the officer has approached you, before he/she goes back to the squad car, ask if they can just give you a warning.  If you do not ask and they go back to their car, most times you are going to get a ticket.</li>
<li>Take good notes immediately after leaving the scene.  These notes may provide you with some idea of how to defend yourself later.</li>
<li>Try to set the court date out as far as possible.  Try to reschedule if possible.  In most cases, if the officer does not show, you automatically win your case.  Try to make it difficult for the officer to attend.</li>
<li>When you do go to court, dress nice and professional.  You also need to make sure that your attitude is in check.</li>
<li>If you see the officer before the court hearing, ask the officer again to dismiss the ticket.  In some jurisdictions, the officer can waive the ticket up until the trial.  They are people too, and maybe they were having a bad day that day.</li>
</ul>

<p>Defective Equipment Could Help You Win</p>
<p>Not all electronic devices are 100 percent accurate all the time, every time. Electronic devices do malfunction, and some even fail. The same can happen to a speed gun that officers use to measure how fast your driving. Many times, they read incorrectly. 			<content:encoded><![CDATA[<p>Every case is different and there are no guarantees. Below are rough answers to some questions we hear frequently.</p>
<p>Q: Will I have to go to Court for my speeding ticket?</p>
<p>A: It depends. Without a lawyer you usually do have to appear in Court. In most courts, good lawyers can resolve your speeding ticket or other traffic charge without you having to go to Court. Criminal Procedure Law 340.50(2) allows for<span id="more-13"></span> a lawyer to appear on your behalf, if the proper paperwork is taken care of. It is possible that the prosecution will object, but that is not common. There are a few courts in the area where you will have to attend, but that is rare.</p>
<p>Q: Do I need a lawyer for a speeding ticket?</p>
<p>A: No, but in many courts a lawyer will get you a better deal than you will get for yourself, with fewer points, a lower fine, less impact on your insurance, and less hassle.</p>
<p>Q: Will my insurance rates go up if I get a speeding ticket?</p>
<p>A: A speeding conviction or other moving violation will be reported on your New York State driving record. If you are insured in New York, points on your license can affect your insurance. It is possible that your insurance company won't find out, but the odds are that they will. The best way to keep your rates down is to get a good lawyer to negotiate to get you a reduction. Insurance Law 2335 discusses in detail what violations can be used by insurance companies to raise your rates. A good lawyer will consider those rules in resolving your ticket.</p>
<p>For out-of-state drivers, there is no simple answer. It is our understanding that New York State reports moving violations to the "Drivers License Compact", and that this can affect insurance rates for out-of-state drivers. It seems like this is applied inconsistently. In some cases the home state never finds out. We have seen cases where they do. NY tickets definitely can affect drivers in New Jersey, North Carolina, Delaware, Florida, Massachusetts, and we have also seen them affect Quebec and Ontario licenses.</p>
<p>For New York drivers who get out-of-state tickets, these generally will not affect you. The exception is tickets in Quebec and Ontario. However, it is always possible that your insurance company will find out, and if they do, your rates might go up. Under Insurance Law 2335, it should not affect you in New York, but that doesn't mean they won't try.</p>
<p>When good lawyers negotiate plea bargains, they minimize the impact on your insurance rates. For out-of-state drivers, a lawyer might seek a reduction to something that has points in New York but not in your state or province.</p>
<p>Q: Can we beat a speeding ticket or traffic charge?</p>
<p>A: Yes, but it may not be worth the money. The police often make mistakes and we can and do win traffic trials. The most common way you can beat a ticket is if the officer doesn't show up. That is very rare. The main reason you would fight a ticket is if you already have several points and you can't get a reduction that will save it. Also, if your job requires a clean license, it may be cost effective. In most cases your lawyer can negotiate a reasonable deal for you. This usually costs much less than doing a trial. You should discuss this with an experienced traffic lawyer.</p>
<p>Q: What do lawyers charge for a speeding ticket?</p>
<p>A: In upstate New York attorney fees are around $500 for most ordinary tickets. If it is a case that will go to trial, the fees would be higher, perhaps $1000 or more. Fees for tickets in New York City and downstate counties, and some other areas may be higher. Also, fees are typically higher if the case involves more serious charges.</p>
<p>Q: What is the point system?</p>
<p>A: When you get convicted of a moving violation the DMV records points on your New York license. All moving violations are at least two points. Most are three points or more. New York recently added a new surcharge of $100 per year for three years if you get six points, plus $25 per year for each additional point.</p>
<p>The following table shows the point values assigned to moving traffic violations. The "points" are assessed against your driving record based on the date you committed the violation, not the date you were convicted in court. If you accumulate 11 or more points in 18 months, you will be called to a DMV hearing, after which your license may be suspended or revoked. You will be offered the option of waiving the hearing or accepting a definite period of suspension.</p>
<p>Some license revocations and suspensions are mandatory and do not depend on points. These include three speeding violations within 18 months, and convictions involving alcohol or drugs.</p>

<p>You try to think of the various advices that your friends told you on how to get out of a speeding ticket. Here are some ways that can help you fight a speeding ticket.</p>
<p>For one thing, you need to pull over<span id="more-12"></span> as soon as it is safe for you to do so. This is when you are caught by an actual traffic police officer. Cameras can't convict you at once so be more courteous to a man than to a machine.</p>
<p>Put both your hands on the steering wheel after you have pulled down the window. When the police officer asks for your driving license, hand it over and do not argue with him or her about it. Don't try to fool the officer by saying you forgot to bring your driving license and such since they can still trace your identity via the car number plate.</p>
<p>Be as honest as to the reason why you are speeding but never on how fast you think you were going. Try to appear to be anxious and you really need to go somewhere that has an emergency and you might be let off.</p>
<p>It helps if you have not had prior discretions if he ever decides to run your car's plate. But make sure that you tell your story before he gets back to his car. Because it is much harder to convince him when he returns and a ticket is harder to void than to actually pay for one.</p>
<p>If the officer is of the opposite sex, try not to use any innuendo when you are talking to him or her. If you offend the traffic officer that might just get you a ticket faster than going 200 miles an hour.</p>
